Service Agreement

  This Service Agreement (this “Agreement”) is made by and between Ruff + Stay LLC (“Pet Sitting Company”) and you (“Client”). The parties hereto agree as follows:

1. Pet Sitting Company agrees to provide pet sitting services (“Services”) to the Client. In consideration of the Services and as an express condition thereof, Client, on behalf of him/her/themselves and related parties, expressly waives and releases Pet Sitting Company from any and all claims against Pet Sitting Company, its owners, employees, consultants, agents and representatives, except those arising from gross negligence or willful misconduct on the part of Pet Sitting Company.

2. If a medical emergency arises while Services are being performed, Pet Sitting Company will make a good faith effort to contact Client. However, if time is of the essence or Pet Sitting Company is unable to reach Client, Client authorizes Pet Sitting Company to obtain medical treatment for the pet(s) in its sole but reasonable discretion and Client agrees and be responsible to Pet Sitting Company for all liabilities related to transportation, treatment, and expenses immediately upon pick-up.

3. Client agrees that Pet Sitting Company will provide updates via Time to Pet. To allow Pet Sitting Company to provide the best Service and attention to the pet(s), Client further agrees to limit contact with Pet Sitting Company to a maximum of once every 12 hours.

4. Client agrees to pay all charges accrued for Services rendered. Client understands that payment is due at or prior to the time of the commencement of Services unless the parties agree upon supplementary payment terms in writing.

5. Client will incur a $25 charge for each returned check, in addition to any and all bank fees attributed to the returned check.

6. Pet Sitting Company shall exercise reasonable precautions against sickness, injury, escape, loss, accidents or death of Client’s pet(s). Pet Sitting Company is not responsible for sickness, injury, escape, loss, accidents, or death of Client’s pet(s) unless caused through gross negligence or willful misconduct on the part of Pet Sitting Company.

7. Client represents and warrants that pet(s) are current on all required state vaccinations and such other vaccinations required by Pet Sitting Company. Client agrees to provide documentation to Pet Sitting Company confirming such vaccinations.

8. Client certifies to Pet Sitting Company that it has disclosed, and shall continue to disclose, on an on-going basis, any and all medical or other conditions, including but not limited to behavior concerns that may affect, limit or prevent the pet’s ability to participate in playtime or interact with people or other animals.

9. Client accepts full responsibility for all medical expenses and other damages resulting from an injury to the Pet Sitting Company, other persons or otheranimal(s) caused by the Client’s pet(s) or negligent act.

10. Client agrees to indemnify, hold harmless, and defend Pet Sitting Company in the event of a claim by any third-party injured or otherwise damaged by Client’spet(s) or negligent act.

11. Pet Sitting Company reserves the right to charge a cancellation fee of 100% of Services that are canceled in less than 24 hours notice.

12. Pet Sitting Company reserves the right to terminate this contract at any time if it determines, in her sole discretion, that the Client’s pet(s) poses a danger to the health or safety of itself, other pets, other people or Pet Sitting Company.

13. Pet Sitting Company reserves the right to refuse Service to any Client, at any time, for any reason.

14. The client is responsible for supplying the necessary equipment and supplies needed for the care of their pet(s) including, but not limited to, a sturdy, well-fit harness or collar, leash, pet food, medications, identification tags, and a bed (collectively, the “Equipment”). Client authorizes Pet Sitting Company to purchase any Equipment that Client fails to supply for the satisfactory performance of the Services and Client further agrees to reimburse Pet Sitting Company for such expenses immediately upon pick-up.

15. Client authorizes Pet Sitting Company to use images of Client’s pet(s) on website, social media, and marketing materials for promotional purposes.

16. The parties hereto agree that this Agreement is valid approval for Services so as to permit Pet Sitting Company to accept all future in-person, telephone, online, mail or email reservations and provide Services without additional signed contracts or written authorizations.

17. The terms of this Agreement apply to all pets owned by Client, including any and all new pets that Client obtains on or after the date this Agreement was entered into.
